All bills must be approved out of their house of origin by May 30th. Dealers have already scored a major victory when SB 994 (Monning, D – Santa Cruz) died in the Senate Transportation & Housing Committee. The bill needed six votes for passage and only received three “yes” votes and one lawmaker voted “no” – while another seven lawmakers abstained from voting which is as good as a “no”vote. SB 994 would have provided unfettered access of vehicle data to any third party vendor who obtains the owner’s consent. Testimony in support and opposition lasted for several hours as leg- islators kept inquiring what exactly the bill’s sponsor – AAA – was getting with the bill’s passage and what type of vehicle data the manufacturers are collecting. As CNCDA’s lobbyist, I argued that vehicle data is too important to grant unlimited access to anyone and could lead to security and public safety threats. I also argued that allowing remote access could lead to odometer tampering and might affect vehicles coming back off lease, warranty claims and used vehicle prices at auction. It was obvious that the bill’s author – Senator Bill Monning – was not fully aware of the potential harm of sharing vehicle data. When it was time to cast their votes, seven lawmakers sat and abstained from voting as their names were repeatedly called and SB 994 was killed! The conversations dealers had with legislators on Dealer Day were crucial in helping to educate them about the safety and security problems with SB 994.
