Get updated on the California Ballot Initiative filed with the California Attorney General late last year, entitled the Car Buyers Protection Act. This initiative goes well beyond prohibiting finance income margins and, if it reaches the ballot and is approved by the voters, would impact all areas of a dealership’s business. The measure’s provisions also include: prohibiting sale or lease contract rescission rights, effectively eliminating the seller’s right to cancel if a dealer can’t obtain financing; prohibiting as-is vehicle sales by requiring written warranties for every used car; prohibiting the sale, lease, rental or loan of vehicles subject to recall, regardless of whether the parts are available; holding dealers liable for identity theft by creating NEWways to sue dealers; strictly prohibiting the hiring of employees with certain criminal backgrounds; and eliminating the right of dealers and automakers to appeal adverse DMV enforcement decisions to the New Motor Vehicle Board. This year’s event will be headquartered at the Sacramento Sheraton Grand Hotel and will include CNCDA’s annual meeting of the members luncheon featuring P.J. O’Rourke, a political satirist highlighted in TIME Magazine and The Daily Beast, who has also written seventeen books. That afternoon the association will set up legislative appointments for all Dealer attendees to meet their representatives at the Capitol, followed by a legislative cocktail reception and dinner.
